What is a TCPA Lawsuit?

The Telephone Consumer Protection Act of 1991 (TCPA) is a federal law which protects individuals from receiving undesirable communications on their telephone or fax machine. It is against the law for a person or business to send unsolicited advertisement via fax, collection calls, robocalls, or texts.

There is an exemption for ads from a business who has established a relationship with the recipient. However, an “opt-out clause” to cancel future faxes. This clause must be presented on the first page of each fax and needs to include a phone number, fax number, or another cost-free method to cancel the fax subscription. So, if you receive spam fax which doesn’t have an opt-out clause, you may be eligible to file a lawsuit against that business.

The TCPA gives individuals the right to pursue a civil action for financial compensation. Plaintiffs can recover between $500 to $1,500 for each fax. If you receive an influx of junk fax, the monetary damages can significantly add up.
